Electronic Payment Terms. Customer may elect to make a one-time payment to be applied against the balance of their monthly billing statement through an electronic funds transfer or a debit or credit card charge (“Electronic Payment”). Customer may also elect to pay the balance of their monthly billing statement via Electronic Payment on a recurring basis, including charges that are due immediately, by enrolling in Auto‑Pay.
One-Time Payment Authorization. By initiating a one-time Electronic Payment, Customer authorizes Clearwave Fiber to charge/debit the bank account, debit or credit card that they designated (“Payment Method”) to make a one-time payment in the amount requested by them.
Auto-Pay/Recurring Payment Authorization. By enrolling in Auto-Pay, Customer authorizes Clearwave Fiber to charge/debit their Payment Method each month to pay the balance due on their account on the due date shown on their monthly bill statement, including charges that are due immediately. Clearwave Fiber will continue to charge/debit their Payment Method each month unless Customer cancels their Auto-Pay authorization at least three (3) business days before the next scheduled payment date. Customer has the right to terminate their Auto-Pay authorization at any time by logging into their eCare account or by calling us at 877-293-2973 at least three (3) business days before the scheduled due date shown on their monthly billing statement for the month in which they want to make the change.
Legal Authorized Use. By authorizing an Electronic Payment, Customer represents that they are the legally authorized user of the Payment Method. Customer is responsible for ensuring that the Payment Method information is current and accurate at all times. Customer agrees to be bound by any rules their financial institution requires for pre-authorized electronic funds transfers and/or that their debit or credit card issuer requires for pre-authorized debit or credit card transactions. Customer is responsible for all fees charged by their financial institution associated with the pre-authorized payment option.
Monthly Statements. Clearwave Fiber will provide Customer with a monthly statement showing account charges prior to the payment due date. The balance shown as due will be deducted/charged to Customer’s Payment Method on or near the payment due date.
Payment Method Changes. Customer must notify Clearwave Fiber of any change in their Payment Method online by logging into their eCare account or by calling us at 877-293-2973 at least three (3) business days before the scheduled due date shown on their monthly billing statement for the month in which they want to make the change. If the change is made after this time, the change will not take effect until the following billing cycle for their monthly billing statement. If Customer is enrolled in Auto-Pay and the initial payment fails, Customer may be charged an applicable payment failure fee in addition to Customer’s past due balance. Customer will remain responsible for taking appropriate actions to ensure that their monthly billing statements are paid when due.
Additional Terms. Clearwave Fiber reserves the right to change these terms or terminate this Auto-Pay program at any time. Customer agrees that Clearwave Fiber may provide legal notices regarding Electronic Payment, the Auto-Pay program, payments made, and other relevant information or records attributable to their payment transactions. Customer may not revoke consent to receive such electronic notice, records, or disclosures. These terms do not in any way terminate, amend or modify other terms, conditions or policies that apply to Customer’s Clearwave Fiber account or any Clearwave Fiber services Customer receives, or other agreements Customer may have with Clearwave Fiber.
Limitation of Liability. Clearwave Fiber shall have no liability or responsibility for its inability to process or receive payments Customer makes or attempts to use an Electronic Payment or otherwise to perform its responsibilities under these Electronic Payment Terms and Conditions in the event circumstances beyond Clearwave Fiber’s control prevent Clearwave Fiber from doing so or otherwise affect Clearwave Fiber’s ability to do so.
CLEARWAVE FIBER’S SOLE AND ENTIRE LIABILITY AND CUSTOMER’S EXCLUSIVE REMEDY FOR THE PROCESSING OR DEDUCTION OF AN INCORRECT ELECTRONIC PAYMENT OF FUNDS HEREUNDER SHALL BE THE RETURN TO CUSTOMER OF THE IMPROPERLY TRANSFERRED FUNDS. CLEARWAVE FIBER SHALL BEAR NO LIABILITY OR RESPONSIBILITY FOR ANY LOSSES OF ANY KIND THAT CUSTOMER MAY INCUR AS A RESULT OF A PAYMENT MADE ON ITEMS INCORRECTLY BILLED OR FOR ANY DELAY IN THE ACTUAL DATE ON WHICH CUSTOMER’S ACCOUNT IS DEBITED OR CARD IS CHARGED.
